Try removing the present Background and then turn off Active Desktop.
Now go to your piture file that you were using and Right Click it and select "Use as Background". (Don't add it through Desktop Properties) It should now be installed without Active Desktop being used.

where is acticve desktop turned on/off?

Sorry, in WinXp it's "Web" view.
Right-click a blank area on the desktop, and then click Properties.
On the Desktop tab, click Customize Desktop.
On the Web tab, click New, and then follow the instructions on your screen.
